A Sword From Blackbeard’s Ship!

Long-time scuba diver Rick Allen makes his living as an underwater photographer. In 2011, he lost his arm in an accident and vowed that it would not stop him from recovering the pirate Blackbeard's ship from the bottom of the ocean. He was fitted with a prosthesis that would allow him to continue to scuba dive, and carry heavy equipment underwater. In June of 2013, he and his crew recovered a cannon and part of a sword. On the whole, sport divers are considered an adventuresome sort. Very curious and interested in the world around them. More often than not, they happen to be talented and creative. “Those doing it for a long time become more like amateur marine biologists,” said Rick Allen, who has been doing it for a long time. During this weekend diving expedition, he served as team leader. Allen has built a career as an underwater videographer, documenting undersea life for various projects. Photographer Tries Novel Legal Strategy To Get The University of Houston To Pay Up!

The service notified Jim Olive of Stockyard Photos in 2016 that the University of Houston's C.T. Bauer College of Business had used one of his aerial photos since 2012, according to his lawsuit. He sent the university a bill for $41,000, which included $16,000 for the frequent use of the photo and $25,000 [per the DMCA] for stripping off Olive's credit line when the university allegedly provided a copy to a national magazine for a story about the university's ranking. Within days, the University of Houston removed the photo from its website, according to court documents. In a August 2016 letter, the university offered to pay $2,500. When Olive threatened legal action, the university said it was immune from federal copyright lawsuits under the common law principle of sovereign immunity. READ THE FULL STORY

Judge Spikes NC Attempts to Dismiss Blackbeard’s Lawsuit! 

Pirates not welcome here! That was the message U.S. District Judge Terrence W. Boyle delivered Thursday, March 23, 2017 to the North Carolina Department of Natural and Cultural Resources (NCDNCR), its employees and the Friends of Queen Anne’s Revenge in response to their motion to dismiss a Federal lawsuit brought by Nautilus Productions LLC. In rejecting the defendants’ attempt to dismiss the copyright claims, Judge Boyle noted that protection of copyrights is a “right of such importance to the founders that it was, unique among most functions undertaken by the federal government today, expressly mentioned in Article I as an important protection to be ensured by the national government.” Judge Boyle’s decision allows the lawsuit for copyright infringement and for a declaration of the statute’s invalidity to move forward in Federal court.
